TERMS AND CONDITIONS

The customer, by booking the Villa Panorama or signing the Booking Form, agrees to abide by the following Rental Conditions:

The property Villa Panorama at 32, Avenue de Provence, Eze/Mer, 06360, France, ("the Property") is offered for holiday rental subject to confirmation by the Owner to the renter ("the Client").

PAYMENT
1. To reserve the Property the Client should complete and sign the booking form and return it together with payment of the initial non-refundable deposit (30% of the total rent due). Following receipt of the booking form and deposit, the Owner will send a confirmation/acceptance of the booking.

2. The balance of the rental amount is due 60 days prior to the beginning of the rental period. If the arrival date is within 60 days of the date of booking, the total rental amount is required for confirmation. Upon receipt of the final payment a RENTAL VOUCHER will be sent to the customer.
If payment is not received by the due date, the Owner reserves the right to give notice in writing that the reservation is cancelled. The client will remain liable to pay the balance of the rent unless the Owner is able to re-let the Property. In this event, Clause 5 of these booking conditions will apply. Reservations made within 60 days of the start of the rental period require full payment at the time of booking.

3. Any chargeable expenses arising during the rental period should be settled locally with the Owners' representative before departure.

4. SECURITY DEPOSIT.

a)For rental less than one month
, the security deposit must be paid directly in cash to the owner or his/her representative upon arrival at the property. The client will receive a receipt of the amount the day of the check in. For one week rental period, a security deposit of 1300E cash or traveler checks is required in case of, for example, damage to the property or its contents. However, the sum reserved by this clause shall not limit the Client's liability to the Owner. The Owner will account to the Client for the security deposit and refund the balance due the day of the departure or within 15 days maximum after the end of the rental period in case of repair. Telephone charges will be deducted from the security deposit.

b) For rental more than one months: 80% of the security deposit must be paid by wire transfer 60 days before the arrival and 20% of the deposit must be paid directly in cash to the owner or his/her representative upon arrival at the property.

Be aware that energy costs are much higher in Europe than in the U.S. THE OWNER OR HIS/HER REPRESENTATIVE MAY REFUSE ACCESS TO THE PROPERTY IF THE DEPOSIT IS NOT PAID.

5. MODIFICATIONS - CANCELLATION CHARGES

WE STRONGLY RECOMMEND YOU TO TAKE A CANCELLATION INSURANCE
In the event of cancellation of a booking, the following penalties must be paid:

30% of the rental price if the cancellation is made at least 70 days before the start of the letting period;

70% of the rental price if the cancellation is made between 69 and 61 days before the start of the rental period; 100% of the rental price if the cancellation is made between 60 days and the start of the rental period.

If Villa Panorama should, for any reason beyond their control, including force majeure, be unable to provide the customer with the property he/she has booked, Villa Panorama reserves the right to transfer the customer, upon agreement, to a different property.

You are advised to take out a Travel Insurance Policy with a Cancellation Clause, such as Travelguard /Europ Assistance, which may enable you to recover non-refundable monies.)

6. PHYSICAL INJURIES:
Villa Panorama is not responsible for any physical injuries caused to the customers during their stay at the property. The Client is strongly recommended to purchase a comprehensive travel insurance policy prior to their trip (including cancellation cover) and to have full cover for the party's personal belongings, public liability etc.

7. ARRIVAL and DEPARTURE At the time of booking the customer must advise the property management of their arrival time. Sundays, holidays, and late night arrivals are usually not possible.
Please note: Any change in arrival date or time must be approved by the property management at least one week prior to arrival at the property. On arrival the customer must show the rental voucher and passport or identity card to the owner or his/her representative; these documents are required for traveler registrations requested by individual national law.

8. CLEANING. The Client agrees to be a considerate tenant and to take good care of the Property and to leave it in a clean and tidy condition at the end of the rental period. The final cleaning fee, will be subtracted from the security deposit at the time of the check out. If the final cleaning has been paid with the rent, and the property is not left in the same general condition in which it was found, or in an unacceptable condition, the property owner or property manager may withhold an additional €200.00 from the security deposit to cover the cost of the final cleaning.
The Client also agrees not to act in any way which would cause disturbance to those resident in neighboring properties.
9. HEATING
Heating costs are always extra and are not included in the rental price, unless specifically noted.

10. EXTERNAL MAINTENANCE - The owner or his/her representative have, if necessary, free access to the property for essential maintenance purposes (garden, etc.).

11. NUMBER OF PERSONS - The number of persons present at the property at all times (adults and children) may not exceed the maximum number of sleeping places indicated in the property description, unless the Owner has given written permission.

12. The rental period shall commence at 3.00 p.m. on the first day and finish at 10.00 a.m. at the latest on the last day. The Owner shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated.

Prices exclude:
Final cleaning €200
Weekly UTILITIES: €200/week
These charges can be deducted from your security deposit at your check out

13. Under no circumstances are children under the age of 6, or pets of any kind allowed to reside in the property, unless the Owner has given written permission.

14. The Client shall report to the Owner's agent without delay any defects in the Property or breakdown in the equipment, plant, machinery or appliances in the Property, and arrangements for repair and/or replacement will be made as soon as possible. Complaints issued following the customer's return will not be considered, nor will give rise to any indemnity.

15. The Owner shall not be liable to the Client:

For any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the property.

For any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner.

For any loss, damage or inconvenience caused to or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owner shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.

16. Under no circumstances shall the Owner's liability to the Client exceed the amount paid to the Owner for the rental period.

17. The Client shall be responsible for and supervise all children and others using the terraces and garden at the Property and take all precautions to avoid injury to them. This contract shall be governed by the French law in every particular including formation and interpretation and shall be deemed to have been made in France. Any proceedings arising out of or in connection with this contract may be brought in any Court of competent jurisdiction in Nice / France.

18. PROPERTY OWNER'S DISCLAIMER - The property owner does not accept any liability for any loss, damage, or additional expenses incurred by the client or any member of the client's party regardless of the cause. The property owner does not accept liability for any injury, death, loss, inconvenience or damage, alteration, delay or cancellation of the booking as a result of war, threat of war, riot or civil strife, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns or with the client's accommodation or other circumstances as amounting to 'force majeure' or Acts of God or other similar events beyond the property owner's control.

19. JURISDICTION - In the event of controversy arising from the booking and property rental, only the French Courts can deal with the matter. By signing the booking form and confirming the booking, the customer implies that Villa Panorama Owner conditions have been understood and have thereby been accepted without reserve and without exception. _
